These Terms of Service ("Terms") are an agreement between you and Onto Mars Productions PTE LTD, a company registered in Singapore at 32 Pekin Street, Singapore 048762 ("Vocabee", "we", "us"), and govern your use of the Vocabee mobile app and its widgets (the "Service"). By downloading or using the Service you accept these Terms. If you do not accept them, please do not use the Service.
Our Privacy Policy explains what data the Service handles and forms part of these Terms.
Vocabee delivers a hand-picked vocabulary word each day, with its meaning, pronunciation, and an example sentence, plus optional spaced-repetition review of words you save, home- screen and lock-screen widgets, daily reminders, and simple progress and streak tracking.
The Service depends on our servers. Words are fetched over the internet — the app ships with no built-in dictionary — so a new installation needs a working connection before it can show you anything. Once content has loaded, the app caches it and remains usable offline for reading; saving, reviewing, and syncing require a connection.
The current version of the Service requires no sign-up, username, or password. Your progress is tied to an anonymous identifier created on your device and stored on it.
We intend to offer optional accounts in a future release so that progress can be recovered and synced across devices. Anonymous use will remain supported. If you choose to create an account, additional terms covering it will be presented to you at that time, and our Privacy Policy will be updated to describe what it stores.
You must be at least 13 years old (or the minimum age of digital consent where you live, if higher) to use the Service. If you are under the age of majority in your jurisdiction, you may use it only with the involvement of a parent or guardian, who accepts these Terms on your behalf. Vocabee is not directed at children under 13.
The Service is free to use. Vocabee Premium is an optional paid upgrade offering:

Current prices, billing periods, and any trial length are shown in the app before you buy, in your local currency, and are the authoritative terms of the offer. We may run promotional or win-back pricing for some users; introductory pricing applies only where the store determines you are eligible.
Purchases are processed by Apple or Google, not by us. Manage or cancel your subscription in your App Store or Google Play account settings — deleting the app does not cancel a subscription. Cancellation takes effect at the end of the current paid period; you keep Premium until then.
Refunds are handled by the store you purchased from, under its policies — we cannot issue them directly. Apple: reportaproblem.apple.com. Google Play: through Google Play's refund process. Statutory rights you have under local consumer law are unaffected by this section.
We may change prices. Changes never affect the period you have already paid for, and any increase to a renewing subscription takes effect only after notice and, where the store or law requires it, your consent. If you do not accept a new price, cancel before renewal.
Use Restore on the paywall to re-apply a previous purchase on a new device or after reinstalling, as long as you are signed in to the same App Store or Google Play account. Restoring recovers your Premium entitlement — it does not recover learning progress (section 3).

The Service, its design, software, and its curated word content are owned by us or our licensors and are protected by copyright and other laws. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial learning.
Individual words and their dictionary meanings are facts of language and are not claimed as our property; the selection, arrangement, editorial writing, and presentation are.
The app currently has no free-text input, so you do not submit content to us and we claim no rights over anything of yours.
We aim to keep the Service running but do not guarantee it will be uninterrupted or error-free. We may modify, suspend, or discontinue features, and we may need downtime for maintenance. If we discontinue the Service entirely while you hold an unexpired paid subscription, we will provide a pro-rata refund for the unused period, or arrange one through the relevant store where required.
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law.
Vocabee is an educational aid. We do not warrant that definitions, pronunciations, or examples are complete, current, or free of error, and the Service is not a substitute for a professional dictionary or for formal instruction. Nothing here excludes liability that cannot lawfully be excluded, and if your local consumer law grants you guarantees that cannot be waived, they still apply.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages, nor for lost profits, lost data, or lost learning progress, arising from your use of or inability to use the Service.
Our total aggregate liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or SGD 100. The fixed floor exists because most users pay nothing, and a cap of zero would be unenforceable in many places — it is not a valuation of your claim.
Some jurisdictions do not allow these exclusions, in which case they apply to you only so far as the law permits.
You may stop using the Service at any time by deleting the app; remember to cancel any subscription separately through the store. We may suspend or terminate your access if you materially breach these Terms, particularly section 7. Sections 8, 10, 11, 13, and 14 survive termination.
We may update these Terms. The effective date above will change, and material changes will be announced in the app before they take effect. Continuing to use the Service after a change takes effect means you accept the updated Terms; if you do not, stop using the Service and cancel any subscription.
These Terms are governed by the laws of Singapore, without regard to conflict-of-laws rules, and the courts of Singapore have exclusive jurisdiction. Nothing in this section removes any mandatory consumer protection you have under the law of your own country, or any right you have to bring proceedings there.
Where you obtained Vocabee from the Apple App Store, the following apply and prevail over anything inconsistent above:
If any provision is held unenforceable, the rest remains in force. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor in connection with a merger, acquisition, or sale of assets. These Terms and the Privacy Policy are the entire agreement between us regarding the Service.
